New rules on equal treatment for agency workers

The Agency Workers Regulations 2010 will entitle agency workers to equal treatment on basic employment conditions after 12 calendar weeks in a given job, including pay and holidays from 1 October 2011. 

Under the Agency Workers Regulations 2010 (SI 2010/93), which implement the Temporary Agency Workers Directive (2008/104/EC), employers will have to give agency workers the same basic working and employment conditions that are ordinarily incorporated into contracts of employment of employees of the hirer. The Regulations enable agency workers to bring a claim in an employment tribunal if they feel that their rights under the Regulations have been infringed or that they have been subjected to a detriment for asserting their rights under the Regulations.
