Additional statutory paternity pay

An employee1 can receive additional statutory paternity pay for up to 19 weeks and one day if his or her child is due on or after 3 April 2011 (or in an adoption situation, if he or she is notified of having been matched on or after 3 April 2011). The employee's average weekly earnings must be equal to or more than the lower earnings limit (£107 from 6 April 2012). The mother or adopter must have returned to work before his or her full entitlement to statutory maternity pay, maternity allowance or statutory adoption pay has been exhausted, and at least two weeks of his or her pay period must remain unexpired.

1 Paternity pay is available to a person of either sex in an adoption situation, and to the spouse, civil partner or partner of either sex of the biological mother of a child. 
2 Or 90% of average weekly earnings if this figure is less than £135.45.
