Court of Session to rule on associative pregnancy discrimination

The Court of Session is hearing an appeal against the Employment Appeal Tribunal decision that the Sex Discrimination Act 1975 does not prohibit associative pregnancy discrimination, and that the issue does not require a reference to the European Court of Justice. 

In this case, the Employment Appeal Tribunal (EAT) held that the Sex Discrimination Act 1975 does not prohibit associative pregnancy discrimination, and that the issue does not require a reference to the European Court of Justice. The Court of Session was due to hear an appeal in November 2011, and its judgment is expected in 2012. It is not clear whether or not the Equality Act 2010 Act can be read so as to prohibit associative pregnancy discrimination.
