  • Case of the week: Organised grouping of employees on service provision change In Seawell Ltd v (1) Ceva Freight (UK) Ltd v (2) Mofatt EATS/0034/11, the Employment Appeal Tribunal found that the employment tribunal had wrongly concluded that the fact that Mr Mofatt, who had been employed as a logistics coordinator with Ceva Freight (UK) Ltd, spent 100% of his time on the Seawell Ltd contract meant that he carried out 100% of the "activities concerned" and thereby constituted an "organised grouping of employees" for TUPE purposes. (Personnel Today)
