On this week's XpertHR Weekly, we discuss the employment tribunal decision in Bainbridge v Atlas Ward Structures Ltd ET/1800212/12, which demonstrates that it is unlawful for an employer to discriminate against an employee by treating him or her less favourably than others because of someone else’s disability. We also discuss the tribunal decision in Griffin v Hyder Brothers Ltd ET/2406224/2011, which highlights some of the problems that can occur when colleagues insist on communicating in their first language, to the possible exclusion of other workers who do not speak this language.
