The Ministry of Justice has published its report on employment
tribunal and EAT statistics for the period 1 April 2011 to 31 March 2012,
including details of compensation awards for successful unfair dismissal and
discrimination claims.
In 2011/12, the median award for a successful unfair dismissal
claim was £4,560. The current cap (effective from 1 February 2012) on the
compensatory award for unfair dismissal is £72,300. However, the Government
is proposing a reduction in the level of the compensatory award for unfair
dismissal, with an individual limit of 12 months' pay in conjunction with a
reduced overall cap.
The median awards in successful discrimination claims were:
- £13,505 for sexual orientation discrimination (highest award: £27,473);
- £8,928 for disability discrimination (highest award: £390,871);
- £6,746 for sex discrimination (highest award: £89,700);
- £6,065 for age discrimination (highest award: £144,100);
- £5,256 for race discrimination (highest award: £4,445,023 in Michalak v Mid Yorkshire Hospitals
NHS Trust ET/1810815/08); and
- £4,267 for religion or belief discrimination (highest award:
£59,522).
The report also sets out who represented claimants in employment
tribunals. Trade unions represented 5,500 claimants (down from 10,000 in
2010/11), while 72,600 were represented by lawyers (down from 142,700 in
2010/11). An additional 34,900 claimants represented themselves (down from
40,400 in 2010/11).

Employment tribunal
statistics show 15% fall in claims There has been a decrease in the number
of claims being brought in employment tribunals, with the number of claims
decreasing from 236,100 in 2009/10 to 218,100 in 2010/11 and decreasing again to
186,300 in 2011/12, according to Tribunals Service statistics.
Government announces further
proposals to "streamline employment law" The Government has announced two
consultations as part of its ongoing review of employment law, seeking views on:
the introduction of a "settlement agreement" scheme; a reduction of the level of
the compensatory award for unfair dismissal; and proposals to simplify tribunal
procedures following Mr Justice Underhill's review of the rules of
procedure. |
