Equality Act 2010: contradictory tribunal rulings over hearing post-employment victimisation claims

We provide summaries of two contradictory tribunal rulings in which the employment tribunals decided that:

• a post-employment age victimisation claim could not proceed on a strict reading of the wording of the Equality Act 2010; and
• a post-employment race victimisation claim would be allowed to proceed because a purposive interpretation should be given to the Equality Act 2010.
