Under the Information and Consultation of Employees Regulations 2004 where the standard provisions apply the employer must provide the information and consultation representatives with certain information. The information that the employer must provide is set out below.

| (2) The situation, structure and probable development of employment within the undertaking (including suitable information relating to the use of agency workers in that undertaking) and any anticipatory measures envisaged, particularly where there is a threat to employment |
With regard to (3), if the employer is required to consult under the statutory collective redundancy or business transfer obligations, it may opt to consult under the relevant legislation instead |
| (3) Decisions likely to lead to substantial changes in work organisation or contractual relations, including transfer of undertakings and collective redundancies |
The content and timing of information must permit the representatives to conduct an adequate study and, where necessary, to prepare for consultation |
