In Coloroll Pension Trustees Ltd v Russell (28 September 1994) EOR58A, the European Court of Justice rules that trustees of occupational pension schemes are bound by Article 119 of the EC Treaty in the same way as employers.

The issues

This important test case on the application of the principle of equal pay and treatment in light of the European Court's decision in the Barber case (see EOR32A) arose out of the financial collapse of the Coloroll Group, which led to the appointment of receivers.
