In R v Ministry of
Defence ex parte Smith and others (3 November 1995) EOR66B, the Court of
Appeal rejects the challenge to the lawfulness of the policy by which
homosexual men and women are not permitted to serve in the armed forces.
The issues
The armed forces does not permit homosexual
men and women to serve, irrespective of whether they engage in homosexual
