Loss of earnings
Claimant agreed that fair dismissal could have occurred during
long term sickness absence - loss limited to contractual sick pay period
Westcott v Braintree District Council 25 May 2004; case
Ms Westcott was unable to look for work, because of her injury,
for more than one year from her accident, although a medical report gave the
view that it would have been unlikely that this could have been predicted at
three weeks from injury.
