The Court of Appeal has agreed with the Employment Appeal Tribunal (EAT) that the reverse burden of proof does not apply in race victimisation cases.

Ms Oyarce claimed that she had been overlooked for promotion because she had earlier brought a race discrimination claim against her employer.
