Equal opportunities employment law manual updates


The equal opportunities chapter of the XpertHR employment law manual has been updated to reflect recent case law dealing with indirect sex and race discrimination, and the protection afforded to volunteers by discrimination legislation. 

  • Ministry of Defence v Debique EAT/0048/09 & EAT/0049/09, in which the Employment Appeal Tribunal (EAT) found that a female soldier, who is a single parent with a young daughter, and who was originally recruited from St Vincent and the Grenadines, was indirectly discriminated against on the grounds of her race and sex.
  • X v Mid Sussex Citizens' Advice Bureau and another EAT/0220/08 & EAT/0511/08, in which the EAT found that a voluntary worker without a legally binding contract was not protected under the Disability Discrimination Act 1995.
