This month’s top 10 HR questions

Many of the questions featured in our 10 most popular questions during February are new additions to the FAQ section of XpertHR – the majority published as the result of subscriber suggestions. Even if your suggestion isn’t suitable for publication as an FAQ, it might still provide useful ideas for guidance that could be published in other areas of the site, or prompt more detailed examination of a problematic subject.

  1. Does a job applicant who wishes to complain of discrimination have to raise a grievance with the employer before bringing a tribunal claim?
  2. If an employer grants a request for an employee to work indefinitely beyond retirement age, is there anything to prevent it seeking to retire the employee at any subsequent time?
  3. What does the phrase 'without prejudice' on a letter mean?
  4. Must a person be authorised to represent a claimant at tribunal for reward?
  5. Where employees are required to live on their employer's premises, are they permitted to smoke in the accommodation provided?
  6. Where an employer stipulates a probationary period for new employees must it wait until the end of this period before dismissing an unsatisfactory probationer?

  8. Can an underperforming employee on a fixed-term contract be dismissed before the end of the fixed term?
  9. Is it safe to dismiss an employee with less than a year's service without following a proper disciplinary procedure?
  10. Where an employer grants a request for an employee to work beyond retirement does it need to repeat the statutory retirement procedure at a later date?
