Having issued a new, non-prescriptive, draft statutory Code of practice on disciplinary and grievance procedures in May, Acas has now published a draft of its proposed accompanying non-statutory guidance.
While a failure to follow the statutory guidance when it comes into force could result in up to a 25% increase or decrease in compensation where an employment tribunal claim is brought - depending on which party is at fault - the non-statutory guidance will have no status in the tribunals. Its purpose is to provide practical guidance about resolving workplace disputes, bearing in mind the nature of the issue and the size and resources of the employer.
Anyone wishing to put forward a view to Acas on the draft guidance and/or statutory code has until 25 July to do so.
