This month's top 10 HR questions

One of the most frequently asked questions throughout July highlights the changes to rights during maternity leave affecting those with an expected week of childbirth on or after 5 October 2008 - the issue of payment of a car allowance during additional maternity leave. Other questions consider a requirement to take outstanding holiday during garden leave and dismissing an unsatisfactory probationer during the probation period.

  1. Where an employee is provided with a cash allowance instead of a company car can this be withdrawn if she goes on maternity leave?
  2. Can an employee be required to take his or her outstanding leave while on garden leave?
  3. Where an employer stipulates a probationary period for new employees must it wait until the end of this period before dismissing an unsatisfactory probationer?
  4. Following a fatality, can directors and senior managers be prosecuted under the Corporate Manslaughter and Corporate Homicide Act 2007?
  5. How soon before a child’s sixth birthday must an application for flexible working be made?
  6. Is alcohol addiction covered by the Disability Discrimination Act 1995?
  7. If a pregnant employee is employed to do suitable alternative work throughout her pregnancy, is her right to return to work after maternity leave the right to return to this job or to her normal position?
  8. Under the age discrimination legislation is an employer prevented from using job titles including the words “senior” and “junior”?
  9. Can an employer offer an employee less money for alternative work during her pregnancy where she cannot do her normal job because of the risks involved?
  10. Is an employer obliged to wait a certain period of time before re-employing an employee who was dismissed for redundancy?
