Language barrier not a disability, says tribunal judge

Following on from the revelation that baldness isn't a disability comes another shocker: neither is inability to speak English.

A Polish worker brought various claims about her time as a hotel cleaner, including claims in relation to unfair dismissal and unpaid wages. With a creative interpretation of discrimination legislation, a disability discrimination claim was added. She argued that not speaking and not understanding a language is a disability and her employer had exploited this disability to pay her less than the national minimum wage.

Despite the impassioned pleas of her representatives ("such discrimination is always dangerous to the principal of equality, a principal so dear to the British soul", they argued), a tribunal judge struck out her disability discrimination claim.
