Consultation on damages-based agreements

The Government consults on damages-based agreements, commonly used to fund representation in employment tribunals. Under these agreements, also known as contingency fee agreements, the fee that is payable to the representative is contingent on the success of the case and is calculated by reference to the amount of damages awarded. These agreements are currently unregulated and views are sought on the requirements that the Government intends to introduce.
