Consultation on reforming the law on misconduct in public office
Close date: 28 November 2016
The Law Commission consults on the common law offence of misconduct in public office. The consultation seeks views on two options for replacing the current offence:
- Option one: a public office holder commits an offence when he or she breaches a duty related to the prevention of serious harm.
- Option two: a public office holder commits an offence when he or she abuses his or her position, power or authority to achieve an improper benefit for him- or herself, or another person.
The consultation also invites views on abolishing the current offence altogether without creating a replacement.
