Consultation on reforming the law on misconduct in public office

The Law Commission consults on the common law offence of misconduct in public office. The consultation seeks views on two options for replacing the current offence:

  • Option one: a public office holder commits an offence when he or she breaches a duty related to the prevention of serious harm.
  • Option two: a public office holder commits an offence when he or she abuses his or her position, power or authority to achieve an improper benefit for him- or herself, or another person.

The consultation also invites views on abolishing the current offence altogether without creating a replacement.
