Consultation on transferring functions of the employment tribunal to the first-tier tribunal in Scotland

The Government in Scotland has published a consultation seeking views on a draft order that will allow first-tier tribunals for Scotland to hear Scottish employment law cases as well as other employment law cases where they have a sufficient connection with Scotland. The draft order sets out the definition of a "Scottish case" and the criteria to identify other employment law cases. Similar provisions will apply to the Employment Appeal Tribunal so that Scottish appeal cases will be heard in the Upper Tribunal for Scotland.

The Employment Tribunals Act 1996 will be amended to restrict the making of procedural rules to employment tribunals in England and Wales.
