Consultation on TUPE

The Government consults on changes to the Transfer of Undertakings (Protection of Employment) Regulations 2006 (SI 2006/246), with a view to reversing "gold plating" of the Acquired Rights Directive (2001/23/EC). Proposals include: reversing the changes made by the Regulations to service provision changes; repealing the requirement to give the transferee employee liability information and providing guidance on the provision of information instead; changing the wording of the provisions that restrict changes to terms and conditions, give protection against dismissal, and concern a substantial change in working conditions to the material detriment of the employee to more closely reflect the Directive; and amending the meaning of "entailing changes in the workforce" to cover changes in location.
