Guidance on the definition of disability

The Government consults on draft amended guidance on determining whether an individual is disabled for the purposes of disability discrimination legislation, to take account of changes to the law coming into force on 5 December 2005. From this date, the Disability Discrimination Act 2005 removes the requirement that mentally ill employees have a condition that is 'clinically well-recognised' and extends the definition of disability to cover progressive conditions such as HIV, cancer and multiple sclerosis from the point of diagnosis.
