In Aitken v Sappi (UK) Ltd, the Employment Tribunal in Dundee rules against a man injured at work, who claimed that the fact that the injury subsequently frustrated the employment contract should not benefit the employer and allow it to dismiss and discriminate against him on the grounds of disability.
