Are employers obliged to advertise jobs internally?

There is no statutory requirement on employers to advertise jobs internally. However, it is good practice to do so and it may assist in defending a discrimination claim if existing employees have full notice of the availability of a post to enable them to apply. If an existing employee takes the view that a lack of internal advertisement was with a view to discouraging him or her from applying, there is a risk that he or she may argue that this was for reasons related to sex, race or disability or for another discriminatory reason.
