Can an employer offer an employee less money for alternative work during her pregnancy where she cannot do her normal job because of the risks involved?
No, a pregnant employee is entitled to be offered suitable alternative work on similar terms and conditions if she is unable to do her normal job because of the risks to her health and safety. The alternative work must be suitable for her, and if the terms and conditions are not the same as normal they must "not be substantially less favourable" (s.67(2)(b) of the Employment Rights Act 1996). If an employee were offered alternative work on less favourable terms and conditions than her normal post she would be entitled to argue that the alternative work was not suitable.
If there is no suitable alternative work available a pregnant employee is entitled to be suspended from work on full pay.
