How are the Information and Consultation of Employees Regulations 2004 enforced?

The Central Arbitration Committee (CAC) may make an order requiring an employer to take steps to comply with the Information and Consultation of Employees Regulations 2004 (SI 2004/3426). Further, where the CAC upholds a complaint, employee representatives may apply to the Employment Appeal Tribunal and a penalty notice may be issued. This may result in a fine of up to £75,000.
