How is an employee's entitlement to shared parental leave affected if his or her child dies?

If an employee's child dies after the employee has submitted a notice of entitlement and intention to take shared parental leave, the employee can take any period of shared parental leave that he or she has already booked. However, if he or she has not yet submitted a period of leave notice, the employee cannot book a period of shared parental leave after the child's death.

If the employee is already on a period of shared parental leave or has already booked leave by submitting a period of leave notice, he or she can submit a variation notice to reduce the length of the period of leave, as long as the employer has at least eight weeks' notice of the new end date, or to cancel the period or periods of leave that have not yet started. However, there is no obligation on an employee to reduce or cancel a period of leave in these circumstances.
