How is the special negotiating body for the establishment of a European Works Council elected?

The Transnational Information and Consultation of Employees Regulations 1999 (SI 1999/3323) provide for the special negotiating body (SNB) to be designed to ensure that each part of the organisation within the European Economic Area is adequately represented. UK members of the SNB are elected by ballot of the UK employees, which must be arranged by the employer. A ballot may be avoided if there is already a group of elected employee representatives who represent all UK employees for the purpose of information and consultation.
