Is a redundant employee still entitled to reasonable paid time off to look for other employment while undertaking a trial period of alternative employment?

The right of an employee to paid time off during the notice period to find a new job applies where the employee is under notice of dismissal for redundancy and has been continuously employed for a period of at least two years.

Where an employee accepts an offer of re-employment and qualifies for a trial period under s.138 of the Employment Rights Act 1996, he or she is not treated as having been dismissed. As the employee is no longer under notice of dismissal, he or she will not qualify for the right to paid time off during the trial period.
