Is an employer acting unlawfully if pay rates vary between employees who perform similar roles?

It is the duty of the employer to ensure that men and women are paid equally for like work, work rated as equivalent or work of equal value. This also applies to the terms and conditions of employment, for example part-time working and benefits for dependants should be available to all employees in the same or similar circumstances. Employers must also ensure that people are not paid less because of any of the protected characteristics, ie age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex or sexual orientation.
