To what extent are the terms of a contract binding?

Express terms are terms that have been agreed between the parties and these will be binding on both the employer and the employee. They may be written, oral or incorporated and cannot in normal circumstances be overridden by implied terms, unless the term is a minimum term implied by statute such as the national minimum wage or minimum notice to terminate a contract. Oral express terms are, however, very unreliable and it is always sensible to put all express terms into writing.
