What are the penalties for non-compliance with the smoke-free legislation?
The smoke-free legislation creates offences and imposes penalties for non-compliance. For an individual found to be smoking on smoke-free premises, there is a £50 fixed penalty notice or a fine of up to £200. Where a person in control of premises fails to display no-smoking signs in smoke-free premises or vehicles there is a £200 fixed penalty notice or a fine of up to £1,000. For a person in control of premises who fails to prevent smoking in smoke-free premises or vehicles, there is a fine up to £2,500. There is no fixed penalty notice for this offence.
