What fees are payable when a party appeals to the Employment Appeal Tribunal?
No fees are payable on lodging an appeal to the Employment Appeal Tribunal. On 26 July 2017, the Supreme Court held that the employment tribunal fees system was unlawful as it prevented access to justice. The Supreme Court quashed the legislation that brought the fees system into force.
Under the system that was ruled unlawful, the appellant was required to pay an issue fee of £400 on lodging an appeal with the Employment Appeal Tribunal, and a hearing fee of £1,200 when the case was listed for a hearing. There was only one level of fee regardless of the type of claim or number of claimants.
