What information must an employer that hires agency workers provide to the agency to comply with the Agency Workers Regulations 2010?

If an agency worker completes the 12-week qualifying period for equal treatment under the Agency Workers Regulations 2010 (SI 2010/93), the hiring employer must provide the agency with details of:

  • the basic pay;
  • overtime payments;
  • shift/unsociable hours payments;
  • risk payments for hazardous duties;
  • bonus schemes and annual pay increments;
  • vouchers that have monetary value; and
  • annual leave entitlement

that the agency worker would have received as a direct recruit.
