What protection is given to special negotiating body or European Works Council representatives?

Like trade union representatives, members of a special negotiating body (SNB) or a European Works Council (EWC) (and prospective candidates for those posts) are protected from unfair dismissal for performing their functions and may claim compensation for being subjected to any detriment for having performed their functions. They are also entitled to time off work to perform their functions. From 5 June 2011, the Transnational Information and Consultation of Employees Regulations 1999 (SI 1999/3323) as amended, require employers to provide SNB or EWC members with the means required to: "fulfil their duty to represent collectively the interests of the employees of the undertaking or group of undertakings" and "undertake training to the extent necessary for the exercise of the employee's representative duties".
