What wages are owed to employees if their place of work is temporarily shut down for health and safety reasons?
If an employer has to shut down the workplace to comply with specified health and safety legislation, employees continuously employed for more than one month may be entitled to payment during the period of medical suspension. Employees are entitled to a week's pay for each week of medical suspension, up to 26 weeks.
Employees are not eligible for medical suspension payments if they:
- are incapable of work because of illness or bodily or mental disablement;
- have refused a reasonable offer of suitable alternative work; or
- have not complied with reasonable requirements imposed in order to ensure that their services were available.
