When can a tribunal claim be heard by an employment judge sitting alone?

Unfair dismissal claims will be heard by an employment judge sitting alone, unless the tribunal directs otherwise.

Section 4(3) of the Employment Tribunals Act 1996 sets out other types of claim that can be heard by an employment judge sitting alone. These include breach of contract, holiday pay and redundancy pay claims.

Most other claims are heard by a panel of three members: an employment judge and two non-legally-qualified members.
