An employer that does not comply with an attachment of earnings order may be liable to a fine in the magistrates' court or in the county court or High Court. The same penalty applies if the employer fails to give proper notice that the employee is no longer in its employment. An employer can defend its failure to comply by showing that it took all reasonable steps to comply or by showing that it could not reasonably be expected to know that the employee was no longer in its employment.
