The Community Charter of the Fundamental Social Rights of Workers, adopted in Strasbourg in December 1989, states that every worker in the European Community "must enjoy satisfactory health and safety conditions and is entitled, in particular, to paid annual leave". A claim for damages arising out of an accident or injury at work could turn on evidence of the defendant employer's failure to ensure that the worker took the holiday and rest breaks to which he or she was entitled.
