What are the main tenets of the European Convention on Human Rights? What is the Human Rights Act 1998?
Article 8 of the Convention reads: "Everyone has the right to respect for his private and family life, his home and his correspondence." An employee's right to privacy in principle extends to the workplace. Workers must be informed if their telephone calls, emails and internet downloads are liable to be monitored or recorded and should be advised of the justification for such actions. In monitoring, the employer should aim to balance the employees' right to privacy with its legitimate business interests, for example to expect its employees to carry out their duties diligently and efficiently.
