Does an employee made redundant while on additional paternity leave have any special rights?

If an employee who qualifies for additional paternity pay is dismissed as redundant should he be paid his full additional paternity pay entitlement?

Is a primary adopter obliged to return to work before taking the full 52-week adoption leave entitlement for his or her partner to be able to take additional paternity leave?

No. The primary adopter must return to work for his or her partner to be able to take additional paternity leave, but there is no requirement for the primary adopter to have any of his or her adoption leave entitlement remaining.

Additional paternity leave in relation to a child adopted within the UK can be taken during the period beginning 20 weeks after the child’s placement for adoption and ending one year after the placement. The primary adopter can choose to begin his or her adoption leave period up to two weeks before the placement. Therefore, the primary adopter could take his or her full entitlement to 52 weeks’ adoption leave and there would still be two weeks remaining for his or her partner to take as additional paternity leave before the end of the first year of the placement.

Where the child is adopted from overseas, adoption leave cannot begin before the child enters Great Britain, so if the primary adopter takes the full 52 weeks, there would not be time for his or her partner to take any additional paternity leave, as it must be taken within the first year after the child enters Great Britain.
