How does a trade union gain statutory protection in relation to industrial action?

A union gains statutory protection by complying with a number of conditions including the strict rules governing the conduct of a secret ballot, and the notification requirements prior to calling any industrial action. This latter includes giving the employer notice of the ballot and a sample voting paper, notice of the result of the ballot and notice of the intended industrial action.
