An employer can require its employees
to give longer notice to terminate their contracts than it is required to give
provided that the employees' notice requirements are clearly set out in the
contract of employment. The employer must also meet the statutory minimum
notice requirements set out in s.86 of the Employment Rights Act 1996. Most
employers require employees to give the same notice as they are entitled to
receive. Indeed, many employees would not agree to a contractual clause
requiring them to give a longer notice period than the employer is required to
give them, on the grounds that they would not wish to be tied to a longer
notice period than the employer.
