How to inform and consult prior to redundancies

  • Be aware that if 20 or more employees are to be dismissed within 90 days for any reason not related to the individual employee concerned, the employer is legally obliged to consult with recognised trade unions or, where there are none, employee representatives.
  • Understand that, while the above point covers mass redundancies, it also covers situations in which 20 or more employees are dismissed and offered new contracts as a consequence of a restructuring or a change in their terms and conditions.
