How to deal with European Works Councils

  • Understand that only an 'undertaking' or 'groups of undertakings' employing at least 1,000 persons throughout the European Economic Area and at least 150 in each of two separate EEA member states is affected by the Transnational Information and Consultation of Employees Regulations 1999 and hence required to establish a European Works Council.
  • If your organisation is below the threshold but might be affected by the regulations in the future, establish and maintain records of employee numbers within the European Economic Area.
