How to protect the employer against claims of unfair dismissal

  • Make sure that you have grounds for dismissing an employee falling within one of the six potentially fair reasons set out in the Employment Rights Act 1996, section 98.
  • Be aware that, even if a reason for dismissal is self-evident, such a dismissal will be unfair if you do not act reasonably in carrying it out by following a fair procedure.
