How to provide a written statement of reasons for dismissal

  • Be aware that under the Employment Rights Act 1996, section 92(1) an employee is entitled to be provided by his or her employer with a written statement giving particulars of the reasons for his or her dismissal if the employer:

      - gives notice of dismissal

      - dismisses without notice

      - does not renew a fixed-term contract

  • When dismissing an employee always confirm the fact and reasons for the dismissal in writing.

  • Understand that an employee may present a claim to an employment tribunal on the grounds either that the employer unreasonably refused to provide a written statement of reasons for dismissal, or that a statement was given but the particulars were untrue or inadequate.
