A week's pay: Provision of board and lodging was part of "a week's pay"

For the purposes of calculating the statutory redundancy payment due to a redundant agricultural worker, the amount of "a week's pay" was the applicable agricultural minimum wage and not that rate less the amount paid by the employer to his mother for board and lodging, holds the EAT in W A Armstrong & Sons Ltd v Borrill 10.11.99 EAT 1124/98. The contract of employment had to be construed and applied so as to comply with agricultural wages legislation, the scheme and effect of which was that the employer's obligation to pay the minimum wage could be satisfied in cash and by the provision of benefits.
