In Agrico UK Limited v Ireland EATS/0024/05, the Employment Appeal Tribunal (EAT) has held that an employment tribunal was wrong to conclude that it was not reasonably practical for Ms Ireland to have presented her unfair dismissal claim within the three-month time period.

Although he had been instructed a week after her dismissal, Ms Ireland's solicitor had left submitting her claim to the tribunal until the last minute. Having gone on holiday, the solicitor left it to a secretary to complete the form and submit it by fax.
