The Employment Appeal Tribunal (EAT) has held that the act of making a written record can not in itself amount to a detriment under race discrimination legislation.

Under the Race Relations Act 1976, section 2 an employee has the right not to be treated less favourably by reason of the fact that he or she has committed a 'protected act'.
